Booking Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION THAT MAY AFFECT YOUR LEGAL RIGHTS, INCLUDING, BUT NOT LIMITED TO, REQUIRING INDIVIDUAL BINDING ARBITRATION OF ANY POTENTIAL LEGAL DISPUTES BETWEEN YOU AND ULTIMATE RESORT VACATIONS, INC. AND WAIVING ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. 

YOU ALSO ACKNOWLEDGE ULTIMATE RESORT VACATIONS IS A BOOKING AGENT AND SHALL HAVE NO LIABILITY WITH RESPECT TO ANY CLAIMS, CONTROVERSIES, OR DISPUTES RELATING TO YOUR STAY AT A RESORT.

Thank you for choosing Ultimate Resort Vacations (“URV,” “us,” or “we”). Please review these Booking Terms and Conditions (“Terms”) carefully to ensure a seamless experience. By reserving a stay through URV with an independent resort (“Resort”), you acknowledge and accept these Terms. For further assistance, please contact URV at 1-877-527-9702.

1. DEPOSIT POLICY

  • A deposit of 30% of the total reservation cost will be charged at the time of booking to confirm Your reservation.
    This deposit is fully refundable up to 31 days prior to arrival.

2. CANCELLATION POLICY

  • No refunds or credits will be provided for no-shows, late arrivals, or early departures.

3. BALANCE DUE

  • For reservations with an outstanding balance, a secure payment link will be sent to collect the balance once the free cancellation period has ended.
  • Full payment must be confirmed through the secure payment link before check-in.

4. CONSTRUCTION NEAR RESORTS

  • From time to time, and in order to grow and improve facilities, Resorts will undergo construction and renovations, and there may be off-site construction projects near Resort property.
  • For off-site construction projects, Resorts have limited (or no) control over these projects, but agree to make reasonable effort to mitigate noise, vibrations, and any potential disruptions. Such efforts may include adjusting room assignments, modifying operational procedures, or implementing additional soundproofing measures where feasible and available. You acknowledge that construction activities are beyond the Resort’s control; no refunds, discounts, or compensation shall be provided due to such factors unless expressly stated otherwise by the Resort.

5. HURRICANE POLICY

URV cares about your safety and well-being, adhering to guidelines from the National Hurricane Center (NHC) and local authorities. The following policies apply in the event of a confirmed hurricane:

Cancellations

  • If the NHC confirms a Category 1 or higher hurricane with an official warning, and the local international airport local to the applicable resort closes due to the storm, if you are scheduled to travel within 72 hours you may reschedule without penalty within six months of the original arrival date (rate subject to change and availability). If you booked directly through URV you should contact our Call Center. If you booked through third parties you must contact your travel providers.
  • Change fees will be waived, and a credit equivalent to the value of the room revenue will be issued as a certificate for a future stay or applied to rescheduled dates.

Late Arrival / Early Departure

  • If you are arriving late or departing early due to confirmed severe weather conditions, you will receive a credit for unused nights, issued as a certificate for a future stay to be used within six months (rate subject to change and availability).

Stay Extensions

  • If you are impacted by flight cancellations, you may extend your stay at reduced rates, subject to availability, based on your new departure schedule.

Relocations

  • You may request URV transfer your reservation to another Resort outside the storm’s path, subject to availability and equivalent room value.
  • Room category cannot be guaranteed, and relocations are ineligible for a return stay.

Rescheduling

  • If you are postponing your trip due to a confirmed hurricane, you may reschedule at the original rate if:
  • Travel is completed within one calendar year of the original reservation. Rescheduling occurs within 30 days of the hurricane.
  • Blackout periods may apply.

Evacuations

In the event of an evacuation during your stay, URV will work with the Resort to facilitate relocation to safety areas or assist with urgent departures.

General Policy

  • This policy takes effect upon official confirmation of a hurricane by the NHC (NOAA) and may be amended without prior notice.

6. LIMITATION OF LIABILITY AND RELEASE OF CLAIMS

You acknowledge that URV is a booking agent. You understand and agree that URV shall have no liability with respect to any claims, controversies, or disputes (“Claims”) relating to your stay at a Resort, including by way of example only, Claims relating to: (a) the facilities, services, activities, excursions, and amenities provided by a Resort or its contractors; (b) acts, errors, omissions, representations, warranties, or ordinary or gross negligence of a Resort or its affiliates, employees, agents, and contractors; or (c) any personal injuries, illness, accident,
death, theft, property damage, or other damage or expenses resulting from the above or otherwise relating to your stay at a Resort, including but not limited to excursions or activities booked through, at, or in connection with your stay at a Resort. To the fullest extent permitted by law, you waive and release URV, as well as its affiliates, employees, agents, and contractors, from any Claims which you may have or which may arise in connection with your stay at a Resort booked through URV, now or in the future. You further agree that URV shall not be liable for any incidental, indirect, exemplary, special, punitive, or consequential damages in
connection with any Claims.

7. CHECK-IN AND CHECK-OUT

  • Check-In Time: 3:00 PM. Check-in is only possible after full payment has been confirmed.
  • Check-Out Time: 11:00 AM.

8. RATE DETAILS

  • Rates may differ from booking to booking. Please refer to the confirmation email provided to you by the resort, your booking channel, or travel advisor for policies relating to the rate for your specific stay.
  • Rates and inclusions are subject to change.
  • 9. OCCUPANCY POLICY
  • Additional fees apply for unregistered guests aged 13 and older, collected prior to check- in.
  • Please ensure your reservation includes the correct total guest count.

10. TRAVEL INSURANCE

  • We recommend purchasing travel insurance to protect against unforeseen circumstances. Refunds are not offered for cancellations within the penalty period.

11. RESERVATIONS AND MANAGEMENT; WEBSITE BOOKINGS

  • All bookings, modifications, and inquiries are managed by URV as the booking agent for the Resorts. You are encouraged to contact URV directly for assistance with your reservations.
  • Bookings made on our website are also subject to our website Terms of Use. Information about our website and our collection and use of data on the website is available at our Privacy Policy.

12. LEGAL TERMS

These Terms are governed by Florida law, without regard to conflict of law principles.

13. DISPUTE RESOLUTION BY BINDING INDIVIDUAL ARBITRATION AND CLASS ACTION WAIVER (“Dispute Resolution”)

PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU AND URV TO RESOLVE CERTAIN DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION, IT LIMITS THE PARTIES’ RIGHTS TO SEEK RELIEF IN COURT, AND IT WAIVES THE RIGHT TO JURY TRIAL AND THE RIGHT TO JOIN WITH OTHERS IN A LAWSUIT.

This section sets out our agreement for resolving all disputes relating to your booking, including but not limited to deposits, reservations, cancelations, and claims arising from or incidental to reservations made through URV. Other than a claim filed in a court that is limited to adjudicating small claims, in the event of any dispute of any nature whatsoever relating to your booking, past, present or future, in law or in equity, including the determination of the scope, validity, or applicability of this agreement to arbitrate, you and URV agree and consent to binding

arbitration at JAMS for all such disputes on an individual (not class) basis before a single arbitrator under the applicable JAMS Arbitration Rules and Procedures in effect at the time of the filing, rather than litigating the dispute in court. You may obtain a copy of the applicable JAMS rules at www.jamsadr.com. If JAMS is unavailable or unwilling to administer arbitration consistent with this section, another arbitration provider shall be selected by the parties that will administer the arbitration consistent with it. If the parties cannot agree on a provider, the parties may ask a court to appoint an arbitrator that will administer the proceeding consistent with this
section.
You and URV also agree that: (a) by their dealings the parties’ conduct is in and affecting interstate commerce; and (b) the Federal Arbitration Act (FAA) applies and governs this agreement. To the extent state law is applicable under the FAA, the law of the state of Florida shall apply, without regard to its choice of law provisions. The arbitrator shall have exclusive authority to determine the scope, validity, and enforceability of this arbitration agreement.
If the arbitration takes place in-person, it shall be held in the City of Miami. If you commence an arbitration action against URV, you must provide notice to URV at: contact@ultimateresortvacations.com

By agreeing to arbitration, the parties are giving up the right to a trial in court and the right to a jury, and there is more limited discovery than might otherwise be available in court. In addition, you and URV agree not to participate in a class action, a class-wide arbitration, claims brought in a representative capacity, or consolidated claims if the other party hereto is a party to the proceeding.

For purposes of this Dispute Resolution section, URV includes its/their past, present, and future officers, directors, employees, agents, representatives, contractors, parent, subsidiaries, affiliates, successors, and assigns.

14. MODIFICATION

To the extent these Terms conflict with other policies, such as the Privacy Policy or Website Terms of Use, these Terms control.

We reserve the right to make changes to these Terms at any time. All changes are effective immediately when we post them to any subsequent bookings made thereafter.

If URV amends the Dispute Resolution section of these Terms, those amendments will not apply to any dispute that arose from any booking made prior to that amendment. If URV terminates the agreement to arbitrate, the agreement to arbitrate will remain effective for disputes that arose prior to the date of termination.
